Yes. Wisconsin law places limits on which documents may be notarized remotely. In Wisconsin those limits cover: wills, codicils, and testamentary or living trusts; powers of attorney; marital property agreements, including prenuptial and postnuptial agreements; and powers of attorney for health care, living wills, and authorizations to disclose health information.

Wis. Stat. § 140.145(10) provides that the remote online notarization section does not apply to a transaction to the extent it is governed by any law governing the creation and execution of: (a) wills, codicils, or testamentary trusts; (b) living trusts or trust amendments for personal use, not including a transaction as defined in § 137.11(15); (c) powers of attorney, not including either a transaction as defined in § 137.11(15) or a limited financial power of attorney for a real estate transaction; (d) marital property agreements; or (e) powers of attorney for health care, declarations to physicians (living wills), and authorizations for use and disclosure of protected health care information. Wisconsin does provide a separate route for these documents: Wis. Stat. § 140.147 allows estate planning documents to be executed remotely where the signing is supervised by an attorney licensed in Wisconsin, both parties are physically in Wisconsin, and the supervising attorney completes an affidavit of compliance. Notaron does not offer that attorney-supervised service, so these documents are outside what we can do online.
